General Terms and Conditions of the 3Kings3Hills Trail Running Festival 2027

§1 Application – Validity

(1) The organizer of the 3Kings3Hills Trail Running Festival is siimple GmbH, represented by its managing directors Daniel and Christina Gotsmich and Rainer Jungwirth (hello@siimple.de).

(2) The General Terms and Conditions, in the version valid at the time of registration, form an integral part of the contract between the organizer and the participant (Participant). Verbal agreements have no legal validity.

§2 Conditions of Participation

(1) All persons who are sufficiently healthy and fit for the selected distance are eligible to participate.
Specific and individual requirements regarding eligibility to participate can be found in the 3Kings3Hills regulations.

(2) The participant bears full personal responsibility for being sufficiently healthy and fit for the selected distance. Each participant must explicitly familiarize themselves with the specific difficulties and risks—in particular, the risk of injury and falls on the sometimes very challenging sections of the selected distance—and prepare and equip themselves accordingly.

(3) Upon registration, the participant declares that they have read the so-called Trail Guide in its entirety and have understood and accepted all points contained therein.

§3 Registration, Changes to Registration, Cancellation

(1) Registration takes place online at www.3kings-3hills.com via the RaceResult timing system. After registering, the participant will receive a confirmation of registration via email. This makes the registration binding for both contracting parties.

(2)Payment of the entry fee in full is due immediately upon registration and is processed via the payment system of Stripe Technology Company Limited (STC).

(3) If a participant withdraws or fails to start, the entry fee will not be refunded. Participants may choose to insure their registration (at their own discretion) through an external cancellation insurance policy.

(4) Changing from a longer to a shorter distance is only possible via email up to 1 week before the event begins. In the event of such a change to a shorter distance, the monetary difference cannot be refunded; instead, a €20 processing fee will be charged. An upgrade from a shorter distance to a longer distance is possible up to 1 week before the start of the event, subject to payment of the difference.

(5) The following cancellation policy applies: Entry fees are generally non-refundable. Only in the event of an injury and upon presentation of a doctor’s note will we refund the entry fee up to 14 days before the start of the event, subject to a €20 fee. The refund will be issued to the original payment method within 14 business days of receipt of the doctor’s note.

§4 Cancellation and Termination by the Organizer

(1) In the event of cancellation or termination of the event by the organizer due to force majeure for which the organizer is not responsible, the participant has no claim to a refund of the entry fee, nor any claim to damages or compensation for any additional expenses already incurred in connection with the event.

(2) Grounds for cancellation or termination due to force majeure include, for example, a pandemic, a strike, revocation of a permit by the authorities, threats of an attack, acts of sabotage, extraordinary weather conditions, or other disasters. This list is not exhaustive.

§5 Exclusion from the Event – Disqualification

(1) The organizer reserves the right to exclude a participant from the event or to exclude them from the official results (disqualification).

(2) Grounds for exclusion or disqualification include:

a) The participant provides false information during registration.
b) The participant is subject to a competition ban imposed by a sports federation (e.g., due to doping).
c) The participant has significantly violated the race rules.

(3) In the event of exclusion or disqualification, the participant is not entitled to a refund of the entry fee.

§6 Liability

(1) By registering, the participant confirms that they have read, understood, and accepted the rules and the terms and conditions of participation for the event.

(2) Participation is at the participant’s own risk. Each participant is personally responsible for ensuring that they are sufficiently trained and physically capable of completing the selected distance. By starting the race, the participant bindingly declares that there are no health concerns preventing their participation and that their fitness level meets the requirements of a trail running competition of the selected course length.

(3) The organizer reserves the right to exclude participants from the start or to remove them from the race at any time if there are apparent health risks.

(4) The courses run primarily along natural trails and are not completely cordoned off. Participants must be prepared at all times for natural obstacles and hazards, in particular uneven terrain, roots, stones, rocks, bodies of water, dead or damaged trees and branches, suddenly changing weather conditions, and encounters with wildlife.

(5) Parts of the course run along or cross public paths and roads. The provisions of the German Road Traffic Regulations (StVO) apply. Every participant is required to comply with these regulations.

(6) Parts of the route run through forested areas. Entering the forest is at your own risk. Participants are advised that typical hazards may exist in the forest, particularly from dead or damaged trees and branches, roots, rocks, bodies of water, insects, animals, and sudden weather events.

(7) Some of the forested areas along the route are owned by the Bavarian State Forests (BaySF) and other forest owners. The legal duty to ensure safety in the forest is limited.

(8) The organizer bears unlimited liability for damages resulting from injury to life, body, or health that are attributable to an intentional or negligent breach of duty by the organizer, its legal representatives, or its agents.

(9) For other damages, the organizer is liable only in cases of willful misconduct or gross negligence. In cases of simple negligence, the organizer is liable only for a breach of a material contractual obligation, limited to the foreseeable damage typical for this type of contract.

(10) The foregoing limitations of liability also apply in favor of the organizer’s legal representatives, employees, and vicarious agents.

(11) The organizer assumes no liability for lost or damaged personal belongings of participants, unless such loss or damage results from intentional or grossly negligent conduct on the part of the organizer.

(12) Costs for medical assistance, rescue operations, or recovery measures caused by the participant or carried out in the participant’s interest may be billed to the participant, provided such costs are not covered by insurance.

(13) The participant is required to carry the mandatory equipment specified in the event announcement throughout the entire competition. The choice of any additional personal equipment (particularly footwear and clothing) is the sole responsibility of the participant and must be appropriate for the weather conditions and the technical difficulty of the course.
The organizer assumes no liability for damage or health impairments resulting from the participant’s unsuitable or inadequate personal equipment, unless such damage or impairment is due to an intentional or grossly negligent breach of duty by the organizer.

(14) The organizer assumes no liability for damages caused by other participants, spectators, or other third parties.
No security or supervision is provided for the use of designated parking areas. Liability for theft or damage to vehicles is excluded, unless such damage results from an intentional or grossly negligent breach of duty by the organizer.

§7 Insurance

Registration does not constitute the organizer taking out accident or liability insurance for the participant. The participant is personally responsible for obtaining their own insurance coverage.

§8 Data Collection and Use

(1) By registering, the participant declares that they consent to the data provided in the registration being collected for timing, placement, and results, and to such data being disclosed to third parties and published on the Internet.

(2) The personal data provided by the participant upon registration will be stored and processed solely for the purposes of organizing and conducting the event. This applies in particular to the data necessary for payment processing (§ 28 of the Federal Data Protection Act). By registering, the participant consents to the storage of this data for this purpose.

(3) The participant agrees that photographs, video recordings, and interviews taken in connection with their participation in the event may be distributed and published in radio, television, print media, books, social media, the Internet, etc., without any entitlement to compensation. In addition, the participant consents to the transfer of their personal data for the purpose of receiving photos produced by a company commissioned by the organizer. However, this does not constitute a declaration by the participant that they wish to purchase such a photo.

(4) The participant consents to the publication of their name, year of birth, team name, bib number, and results in all event-related print media (participant list, results list, etc.) as well as in all digital media.

(5) The participant may object to the disclosure and publication of their personal data to the organizer in writing or by email.

§9 Statute of Limitations

Claims by the participant against the organizer are barred one year after the end of the event.

§10 Invalidity of Individual Provisions

Should one or more provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. The parties agree that the invalid provision must be replaced by an agreement that corresponds to the content and purpose of the invalid provision.

§11 Jurisdiction

The place of jurisdiction for disputes arising from this contract is Passau. The contractual relationship between the Organizer and the Participant is governed exclusively by German law.
